Ratio Decidendi

The court found that although it had issued interim orders restraining the respondent from recruiting for the position of Finance Manager, there was no evidence that the order was served on the respondent before the appointment was made. As the recruitment process had already been completed and the orders sought had been overtaken by events, the court declined to confirm the interim injunctive orders. The court granted the applicant leave to amend the Memorandum of Claim, as this was not opposed by the respondent and no prejudice would be occasioned. Directions were issued for the filing of amended pleadings and agreed issues, with costs in the cause.
