Ratio Decidendi

The court found that the applicant had demonstrated that an arbitral award was rendered in its favor following a valid arbitration process pursuant to an engagement agreement containing an arbitration clause. The respondent did not contest the application or present any material to challenge the award or its enforcement. The court held that, under sections 32A and 36 of the Arbitration Act, arbitral awards are final and binding, and the applicant was entitled to recognition and enforcement of the award as a judgment of the court. The application was therefore merited and granted with costs to the applicant.
