Ratio Decidendi

The court found that although both suits concern the same subject matter and parties, the current suit (ELC 133 of 2020) was filed earlier and was active when ELC 178 of 2009 was filed. Therefore, the doctrine of sub judice does not apply to bar the current suit. However, the court determined that consolidation would not serve any useful purpose as the issues in the current suit can be fully articulated in ELC 178 of 2009, and maintaining both suits would only convolute the dispute. The court concluded that it is not tenable to sustain the current suit, even in a consolidated platform, and thus struck out ELC 133 of 2020, with costs to abide the outcome of ELC 178 of 2009.
