Ratio Decidendi

The court found that although the delay in filing the appeal was inordinate, the applicant had provided an explanation related to difficulties in obtaining the judgment and challenges posed by the COVID-19 pandemic. Applying the principles set out by the Supreme Court in Nicholas Kiptoo Arap Korir Salat, the court exercised its discretion in favor of the applicant, finding that the interests of justice warranted granting the extension of time to appeal, subject to the condition that the decretal sum be deposited in a joint interest earning account or in court within 30 days.
