Procedural Posture

Employment Cause / Judgment

  1. 1 Whether the claimant's suit was time barred under section 90 of the Employment Act, 2007.
  2. 2 Whether the claimant was unlawfully terminated from employment by the respondent.

Ratio Decidendi

The court found that the claimant's suit was time barred under section 90 of the Employment Act, 2007, as it was filed more than three years after the effective date of dismissal. The limitation period lapsed on or about 1 January 2010, but the suit was filed on 23 September 2011. The court held that limitation of actions is a jurisdictional issue, and therefore, the suit could not be entertained regardless of the merits of the claimant's allegations of unlawful termination. Consequently, the suit was dismissed for want of jurisdiction due to being filed out of time.

Court Disposition
