The Tribunal found that the notice of termination dated 21st June 2023 was the subject of a previous suit between the same parties, and the issue of its validity had been directly and substantially determined in that earlier proceeding. The Tribunal held that the Landlord was required to issue a fresh notice in compliance with the prior ruling and the law, which he failed to do. On the issue of breach of the tenancy agreement, the Landlord provided photographic evidence of alleged unauthorized construction by the Tenant, which the Tenant did not rebut, shifting the burden of proof to the Tenant, who failed to discharge it.
