The transfer of BUNGOMA SPMCC No 123 of 2001 to the Environment and Land Court was done without jurisdiction. As a result, all orders made in the absence of a valid suit, including the consent order and the dismissal order, were issued in error and are vacated. The application seeking reinstatement of the suit and the bill of costs filed by the defendant were struck out for lack of foundation. The file was ordered to be returned to the original court for proper directions, and the Environment and Land Court file was marked as closed.
