Ratio Decidendi

The court found that since the plaintiff vacated the suit land in 2010 and the defendant continued to withhold the refund, the plaintiff was deprived of the use of his money from that time. Guided by section 26(1) of the Civil Procedure Act and the reasoning in Lwanga vs. Centenary Rural Development Bank, the court exercised its discretion to award interest from the date of filing suit. The court reviewed and varied its earlier order to specify that the refund of Kshs 200,000/- would accrue interest at court rates from the date of filing suit until payment in full.
