Ratio Decidendi

The court found that there was no dispute as to retainer and the certificate of taxation for Kshs. 400,000/- had not been set aside or altered. The applicant was therefore entitled to judgment for the taxed amount. Regarding interest, the court applied Rule 7 of the Advocates Remuneration Order, awarding interest at 14% per annum from 30 days after the date the respondent's counsel entered appearance (deemed as the date of service of the bill), i.e., from 12th July, 2018, as there was no evidence of an earlier service date. The applicant was also awarded the costs of the application.
