Ratio Decidendi

The court found that the Respondent failed to comply with statutory requirements under Sections 41 and 35(1) of the Employment Act, 2007, by not providing the Claimant with a hearing or adequate notice prior to termination. The employment relationship was established by contract and continued until 2012. The termination letter did not satisfy the legal requirements for fair termination, as it did not afford the Claimant an opportunity to be heard or explain himself regarding any alleged misconduct or poor performance. Consequently, the court held that the termination was both unlawful and unfair, entitling the Claimant to compensation and terminal dues as specified by law.
