However, since the Defendant admitted receipt of part payment and expressed willingness to refund it less 25% of the deposit as per the contract, the court ordered the Defendant to refund the Plaintiff Kshs. 2,300,000/- less 25% of the deposit paid at execution. Each party was ordered to bear their own costs.
