Procedural Posture

Civil Suit / Ruling on Application to Strike Out Suit Against 3rd Defendant

  1. 1 Whether the 3rd Defendant, Gameco LLP, should remain a party to the suit despite no allegations or prayers being made against it.
  2. 2 Whether the Plaintiffs have disclosed a reasonable cause of action against Gameco LLP.

Ratio Decidendi

The court found that no wrongdoing or relief was sought against Gameco LLP, and its only connection to the dispute was a commercial contract with one of the Defendants, the validity of which was not in question. The Plaintiffs' claim for accounts could be addressed by the 1st Defendant without involving Gameco as a substantive party. Therefore, it would be unfair and unnecessary to require Gameco to defend the suit, and the application to strike out the suit against Gameco was allowed with costs.

Court Disposition

Application allowed; suit against 3rd Defendant struck out with costs.

Orders

  • The Notice of Motion dated 22nd October 2019 is allowed with costs.
