Ratio Decidendi

The appellate court found that the trial court erred in law by holding itself functus officio and by finding that service on only one of two law firms on record was sufficient. The trial court also erred in holding that the supporting affidavit could not be sworn by counsel. The appellate court held that the trial court failed to exercise its discretion judiciously under Order 12 Rule 7 of the Civil Procedure Rules, as there was no evidence that the appellant was seeking to obstruct or delay justice, and the right to be heard is fundamental. The appellate court therefore set aside the trial court's ruling and order, reinstated the appellant's suit, and awarded costs to the appellant.
