Procedural Posture

Employment Cause / Judgment

  1. 1 Whether the claimant's termination was unfair and unlawful under the Employment Act.
  2. 2 Whether the respondent followed due process in suspending and terminating the claimant.
  3. 3 Whether the claimant is entitled to compensation and other terminal dues.

Ratio Decidendi

The court found that although there may have been a valid reason for the claimant's dismissal (neglect of duty), the respondent failed to follow the mandatory procedural requirements under sections 41 and 45 of the Employment Act. The claimant was not afforded a disciplinary hearing nor issued with a termination letter. This procedural lapse rendered the termination unfair and unlawful. The court therefore awarded the claimant compensation for unfair dismissal, salary for days worked, pay in lieu of notice, pay in lieu of leave, a certificate of service, and costs of the suit.

Court Disposition

Claim allowed in part; claimant awarded compensation and terminal dues for unfair dismissal.

Orders
