The earlier suit had been conclusively determined by a competent court, which dismissed the claim that the appellants were the legitimate office holders of the Kenya Shoe and Leather Workers Union. The subsequent suit, filed barely 15 days after the earlier judgment, sought substantially the same reliefs against the same parties.
