The court found that although the plaintiff's former counsel failed to notify him of the notice to show cause and did not take steps to prosecute the suit, the plaintiff, now acting in person, had demonstrated interest and readiness to proceed. The court held that litigants should not be unduly punished for their advocates' failures where they show willingness to prosecute their case. However, the defendants were entitled to thrown away costs due to the inconvenience caused by the plaintiff's default.
