The court found that although the applicant filed the notice of appeal within the prescribed period, he failed to serve the notice on the respondents within time and did not serve the letter requesting proceedings. The applicant was therefore not entitled to the benefit of the exclusion of time for preparation of proceedings under Rule 82. The delay in filing the record of appeal was over two years and was not explained satisfactorily. Applying the principles set out by the Supreme Court in Nicholas Kiptoo Arap Salat v IEBC, the court held that the applicant had not established a proper basis for the exercise of discretion in his favour.
