Ratio Decidendi

The court found that while the Respondent alleged gross misconduct as the reason for dismissal, it failed to prove a valid reason as required by Section 43 of the Employment Act, 2007. Furthermore, the Respondent did not follow the mandatory disciplinary procedures outlined in Section 41 of the Act, as the process was not allowed to run its full course. The court concluded that the dismissal was both substantively and procedurally unfair. As a result, the Claimant was entitled to compensation for unfair dismissal and payment in lieu of notice, but not to other claims such as underpaid salaries, leave allowances, gratuity, terminal dues, or general damages, as these were not proved.
