The Court of Appeal held that the date of conversion for both general and special damages must remain as 14th December 1992, the date of the High Court judgment, since this was not expressly varied on appeal and the issue was not argued before the appellate court. The court further held that interest on special damages should accrue from the date of suit, 10th March 1987, at the normal rate of 12% per annum, in accordance with section 26(1) of the Civil Procedure Act, as special damages are for losses already incurred at the time of filing.
