The tribunal found that although the sale and purchase agreement between the parties was never finalized, there was a mutual understanding and representation by the landlord that rent would not be payable during the negotiation period. The tenant relied on this representation and did not pay rent for that duration. The tribunal held that it would be unjust to require the tenant to pay rent for the period covered by the negotiations, as both parties reasonably believed the tenancy would convert to a sale. However, for arrears accrued outside this period, the tenant remained liable, and the tribunal found that the tenant could not unilaterally grant themselves a 50% rebate on arrears...
