Ratio Decidendi

The court found that the Plaintiffs had raised a substantive issue as to whether the suit land is held by the Defendant in customary trust for the family, which could only be determined at full trial. Given the risk of alienation or disposal of the land before the main suit is heard, and the overriding interest of customary trusts under the Land Registration Act, the court held that the Plaintiffs had established a prima facie case warranting protection of the status quo. The court therefore granted an interlocutory injunction restraining the Defendant from interfering with the suit land until the suit is heard and determined.
