Although the High Court retains jurisdiction to hear and determine divorce petitions, including those involving Islamic marriages, the prudent and proper forum for dissolution of a marriage solemnized under Islamic Law is the Kadhi’s Court, especially where the marriage remains valid under Islamic Law at the time of the petition. The petitioner’s reversion to Christianity does not alter the status of the marriage, which remains an Islamic marriage until dissolved. Section 5 of the Kadhi’s Court Act and Article 170(5) of the Constitution confine the Kadhi’s Court’s jurisdiction to cases where all parties profess Islam and submit to its jurisdiction, but do not oust the High Court’s...
