The court found that the applicant provided a plausible explanation for the delay in filing the appeal, namely, the lengthy internal processes required for authorisation within the company. The court held that a three-month delay, in the circumstances, was not inordinate and did not occasion prejudice to the respondents. The court exercised its discretion in favour of the applicant, guided by statutory and constitutional provisions as well as relevant case law, and granted leave to appeal out of time. However, the court also considered the respondents' rights and awarded them costs for the application.
