Procedural Posture

Stay Application / Ruling on Application for Leave to Appeal and Stay of Proceedings

  1. 1 Whether leave of the Employment and Labour Relations Court is required to appeal its decision to the Court of Appeal.
  2. 2 Whether the trial court has jurisdiction to grant stay of proceedings pending appeal to the Court of Appeal.
  3. 3 Whether the application for stay of proceedings and leave to appeal should be granted.

Ratio Decidendi

The court held that the right to appeal from the Employment and Labour Relations Court to the Court of Appeal is provided by statute and the Constitution, and does not require leave of the trial court. The directions previously issued by the court requiring leave were made in error. The court further found that it lacked jurisdiction to grant the orders sought for leave to appeal and stay of proceedings, as such applications should be made before the appellate court. The application was therefore dismissed for want of jurisdiction, and the court declined to grant any of the orders sought by the applicant.

Court Disposition

Application dismissed for want of jurisdiction.

Orders

  • The application for leave to appeal is dismissed.
  • The application for stay of proceedings pending appeal is disallowed.
