The High Court found that the trial court correctly apportioned liability at 70:30 in favour of the appellants, as the evidence showed the deceased contributed to the accident by crossing the road while intoxicated and without due care. However, the trial court erred in applying a dependency ratio of 1/3, as there was uncontroverted evidence from the Chief's letter and witness testimony that the deceased had three children who were her dependants. The dependency ratio should have been 2/3. The court also found that the award for pain and suffering was too low given the deceased survived for three months after the accident and increased it to Kshs. 200,000.
