Ratio Decidendi

The court found that the plaintiff had established a prima facie case for the grant of a stay of proceedings. The insurance policy in question contained exclusions for false or fraudulent claims and for drivers under the influence of alcohol, which were central to the dispute. Proceeding with the primary suit before determination of the disclaimer suit would risk rendering the latter suit otiose and could result in injustice. The court therefore exercised its discretion to stay the proceedings in the primary suit pending the outcome of the disclaimer suit, with directions to expedite the hearing and a sunset clause for the stay order.
