The inquest magistrate exceeded his jurisdiction by ordering that the applicant be arrested and charged with murder, as this directive usurped the exclusive prosecutorial mandate of the Director of Public Prosecutions under Article 157(6) of the Constitution. The proper procedure, as set out in Section 387 of the Criminal Procedure Code, required the magistrate to forward the inquest findings to the DPP for independent consideration and decision on whether to prosecute. The magistrate's order was therefore a misdirection and was made in excess of jurisdiction.
