The applicant failed to seek an extension of time to apply for joinder as the deceased plaintiff's legal representative, which is a mandatory procedural step under Order 24 Rule 3 and as clarified by the Court of Appeal in Rebecca Mijide Mungole & another v Kenya Power & Lighting Company Ltd & 2 others. Without such extension, the court lacks jurisdiction to entertain applications for substitution or revival. Consequently, the application for revival and substitution was incompetent and was struck out.
