The court found that the applicant had demonstrated sufficient cause for the grant of stay of execution pending appeal. The risk of committal to civil jail for non-payment of costs constituted substantial loss. The application was made within a reasonable time, and both parties agreed to the deposit of the decretal sum as security. The court exercised its discretion under Order 42 Rule 6 of the Civil Procedure Rules to grant a conditional stay of execution, requiring the applicant to deposit the entire decretal sum in a joint interest-earning account and to file the record of appeal within fourteen days. Failure to comply would result in the lapse of the stay order.
