The Tribunal found that the dispute was between members of a political party and the party itself, falling under Section 40(1)(b) of the Political Parties Act. Section 40(2) requires such disputes to first be subjected to the party's internal dispute resolution mechanisms (IDRM) before the Tribunal can assume jurisdiction. The Jubilee Party constitution provides for an appeal from the County Disciplinary Committee to the National Disciplinary Committee, and the complainants were expressly notified of this right in the letters communicating their suspension.
