The High Court found that the trial magistrate's award of Kshs. 2,000,000 in general damages was excessive when compared to awards in similar cases and the nature of the injuries suffered by the minor. The court reviewed the injuries, the authorities cited by both parties, and considered inflation. It determined that an award of Kshs. 1,650,000 was more appropriate, applying a 10% adjustment to a comparable precedent. After deducting the agreed 20% contributory negligence, the net award was set at Kshs. 1,320,000. The court substituted the trial court's award accordingly and awarded costs of the appeal to the Appellant.
