Criminal Appeal / Second Appeal From Conviction and Sentence After Plea of Guilty

  1. 1 Whether the elements of the offence of defilement and the penalty were fully explained to the appellant before he pleaded guilty.
  2. 2 Whether the trial court warned the appellant of the penalty following a plea of guilty.
  3. 3 Whether the appellant's fair trial rights under Article 50 of the Constitution were violated.

Ratio Decidendi

The Court of Appeal found that the appellant was properly convicted on his own plea of guilty. The charge was read to him in a language he understood, and he admitted the facts when they were explained to him. The court held that the requirements for taking a plea of guilty, as set out in Adan v Republic, were satisfied. Section 348 of the Criminal Procedure Code bars appeals from convictions based on guilty pleas except as to the extent or legality of the sentence, and no such issue was raised. The appellant's fair trial rights were not violated, and the sentence imposed was the one prescribed by law. The appeal was therefore without merit and was dismissed.
