The court held that once a suit has reached the execution stage, the requirement for substitution of a deceased decree holder does not apply, as expressly provided by Order 24 Rule 10 of the Civil Procedure Rules. The abatement of suits and substitution of parties are not applicable to execution proceedings. The lower court erred in dismissing the suit for want of substitution, as the judgment had already been delivered and only execution remained.
