The Applicant's employment was terminated on 28th April 2010, and the statutory period for filing a claim lapsed on 28th April 2013. The pendency of criminal proceedings did not prevent the Applicant from filing his claim within the prescribed period, as criminal and civil proceedings are mutually exclusive and governed by different legal standards. The court therefore lacked jurisdiction to grant leave to file the claim out of time, and the application was dismissed.
