The High Court found that the deceased was indeed a passenger in the Probox vehicle KCH 831U, based on the weight of evidence from the plaintiff's witnesses and documentary evidence, overruling the unreliable testimony of the defence. On liability, the court held that the lorry driver (3rd respondent) was primarily to blame for the accident, as he crossed his lane and collided with the Probox, which was on its correct side of the road. The court found no sufficient evidence that the Probox was overtaking at the time of the accident. However, the Probox was partly on the road when stationary, which contributed to the accident.
