Ratio Decidendi

The Court of Appeal held that in succession matters, an appeal from the High Court does not lie as of right. The applicants were required to obtain leave of the High Court before approaching the Court of Appeal. Since leave was neither sought nor obtained, the application for leave to file and serve an appeal out of time was incompetent. The absence of leave deprived the Court of Appeal of jurisdiction to entertain the application. Consequently, the application was struck out and costs awarded to the respondent.
