Procedural Posture
Environment and Land Appeal / Ruling on Dismissal for Want of Prosecution
Legal Issues
- 1 Whether the appeal should be dismissed for failure to file and serve the record of appeal within the court-ordered timelines.
- 2 Whether persistent non-compliance with court directions warrants dismissal of the appeal.
- 3 Whether costs should be awarded to the respondent upon dismissal.
Ratio Decidendi
The court found that the appellant had repeatedly failed to comply with court orders to file and serve the record of appeal, despite being granted extensions and opportunities to do so. The appellant's advocate admitted to losing contact with the client and indicated an intention to cease acting, demonstrating a lack of interest in prosecuting the appeal. The respondent's request for dismissal was justified due to serial non-compliance and want of prosecution. Accordingly, the court exercised its discretion to dismiss the appeal and awarded costs to the respondent, in line with established principles of civil procedure and the need to uphold the authority of court orders.
Court Disposition
appeal dismissed for want of prosecution and non-compliance with court orders
Orders
- The appeal is dismissed.
- Costs shall follow the event and are awarded to the respondent.
