Ratio Decidendi

Additionally, the Respondent had not requested the deputy registrar to list the appeal for dismissal under Order 42 Rule 35(2). The Appellants had demonstrated efforts to obtain the lower court proceedings necessary to prepare the Record of Appeal. Therefore, the application for dismissal was premature and not merited.
