Procedural Posture

Notice of Motion / Ruling on Application to Lift Inhibition Order Post Judgment

  1. 1 Whether the inhibition order registered against the suit property should be lifted following dismissal of the plaintiff's suit.
  2. 2 Whether the pendency of an appeal justifies the continued existence of the inhibition order.

Ratio Decidendi

The court held that the inhibition order was granted to preserve the suit property pending the determination of the dispute between the parties. Although the plaintiff's suit was dismissed, she filed a notice of appeal and the appeal is still pending. The existence of the appeal means the dispute is not fully resolved, and the outcome of the appeal could affect the rights to the property. The absence of a formal stay of execution does not, by itself, justify lifting the inhibition. Therefore, the application to lift the inhibition order was found to lack merit and was dismissed with costs to the plaintiff.
