Miscellaneous Application / Ruling on Application for Judgment on Taxed Costs

  1. 1 Whether the applicant is entitled to judgment for the taxed costs as per the certificate of taxation.
  2. 2 Whether there is any justification to decline the orders sought given the absence of a dispute on retainer or challenge to the certificate of taxation.

Ratio Decidendi

The court found that the applicant had produced a valid certificate of taxation for Kshs. 117,225, which had not been set aside, varied, or appealed against. There was no dispute as to the retainer. In the absence of any opposition or legal justification to decline the orders sought, and in accordance with section 51(2) of the Advocates Act, the court was satisfied that judgment should be entered for the applicant for the taxed sum. The court noted that no prayer for interest was made and therefore none was awarded. Costs of the application were also awarded to the applicant.
