The Court of Appeal found that the applicants had demonstrated an arguable appeal on the issue of whether the sale agreement was frustrated, satisfying the first threshold for stay under rule 5(2)(b). The court further held that the applicants, being in occupation of the suit property and facing imminent eviction, would suffer irreparable loss if stay was not granted, as the property could be transferred to third parties and such loss would not be adequately compensated by damages. The court was satisfied that both the arguability and nugatory aspects were met, and thus allowed the application for stay of execution pending the determination of the intended appeal.
