Ratio Decidendi

The court found that the applicant, Moses Ngunjiri Kiboi, did not acquire a good title to the motor vehicle KBR 742A because the 1st Respondent, from whom the title purportedly flowed, did not have good title himself. The 1st Respondent's purchase was incomplete as the cheques issued for the vehicle were dishonoured, and thus, he could not pass title to the applicant. The vehicle remained legally owned by the 2nd Respondent and Equity Bank. The court further held that the applicant failed to establish a prima facie case for the grant of injunctive or preservation orders, as the 2nd Respondent demonstrated legal ownership and there was no justification to deprive it of use of the vehicle....
