Ratio Decidendi

The court held that the applicant is entitled to execute the decree arising from the judgment of 24.6.2021 as there is no valid stay of execution in force, either from this court or the Court of Appeal. The notices of appeal filed were found to be incompetent, and the Court of Appeal had dismissed the application to validate them. The mere intention to file a reference before a three-judge bench does not constitute a bar to execution. The pending appeal was deemed likely to suffer the same fate as the dismissed applications. Therefore, the application for execution was found to be merited and allowed in its entirety.
