Ratio Decidendi

The trial court imposed a default sentence of three years imprisonment for non-payment of a fine of Kshs. 100,000. However, section 28(2) of the Penal Code limits the maximum default sentence for fines exceeding Kshs. 50,000 to 12 months. The sentence imposed by the trial court was therefore unlawful. The High Court, exercising its revisionary jurisdiction under section 362 of the Criminal Procedure Code, set aside the unlawful sentence and substituted it with a sentence of three years imprisonment from the date of conviction, thereby correcting the illegality and ensuring compliance with statutory limits on default sentences.
