The High Court found that both the appellant and respondent claimed to be on their rightful lanes at the time of the accident, and there was no conclusive police investigation report or independent evidence establishing fault. The trial court's finding of 100% liability against the appellant was therefore erroneous. Applying the principle that, in the absence of clear evidence, liability should be apportioned, the court held the appellant 60% liable and the respondent 40% liable. On the issue of damages, the court found that the award of Kshs. 750,000 in general damages was not inordinately high, given the nature of the injuries and comparable case law.
