The Tribunal found that the notice to terminate the tenancy issued by the landlady was invalid as it did not comply with the statutory requirements under Section 4 of Cap 301, specifically lacking the prescribed form, minimum notice period, and invitation to object. Consequently, the landlady was not entitled to evict the tenant on the basis of that notice. Regarding compensation, the Tribunal held that while the tenant claimed Kshs. 502,400 for construction of a public toilet, only Kshs. 213,600 was strictly proved through receipts.
