The Court of Appeal held that section 21(4) of the Government Proceedings Act expressly prohibits personal liability of government officers for payment of government debts, and that execution or attachment cannot issue against them in their individual capacity. The Attorney General, Solicitor General, and Cabinet Secretary for Defence were not personally liable for the government debt, nor could they be held in contempt for failure to pay, as they had no statutory duty to effect payment. Only the Principal Secretary/Accounting Officer in the Ministry of Defence, who was responsible for payment under section 21(3), could be held in contempt for non-compliance with the mandamus order.
