The proposed appeal raised triable issues, and any prejudice to the respondent could be compensated by costs. On the issue of stay of execution, the court held that the applicant had demonstrated the likelihood of suffering substantial loss if the decretal sum was paid out before the appeal was heard, especially since the respondent had not shown he was a person of means.
