Procedural Posture

Civil Appeal / Application for Substitution of Respondent

  1. 1 Whether the applicant has provided sufficient authority to be substituted as a party in place of the deceased respondent.
  2. 2 Whether the application for substitution was filed within the prescribed time under the Court of Appeal Rules.

Ratio Decidendi

The application for substitution was filed within the twelve-month period prescribed by Rule 102 of the Court of Appeal Rules. However, the applicant only produced a limited grant of letters of administration, which authorized representation in specific succession causes and not in the present appeal. As the applicant did not provide letters of administration authorizing him to represent the deceased's estate in this Court of Appeal matter, the Court found it had no basis to grant the substitution. The application was therefore dismissed, but the applicant was given liberty to obtain and present the appropriate letters of administration and reapply for substitution.
