Criminal Case / Ruling on Bail Application Pending Trial

  1. 1 Whether the applicant should be admitted to bail or bond pending trial for the offence of murder.
  2. 2 Whether compelling reasons exist to justify denial of bail under Article 49(1)(h) of the Constitution.
  3. 3 Whether the applicant poses a flight risk or is likely to interfere with prosecution witnesses if released on bail.

Ratio Decidendi

The court found that the circumstances which previously justified denial of bail—namely, hostility at the locus in quo and risk to the applicant's safety—no longer existed, as confirmed by the pre-bail report and the prosecution's concession. The court determined that the applicant had a fixed abode, was not a flight risk, and there was no evidence that he would interfere with prosecution witnesses. The bitterness of the victim's family, while acknowledged, could not override the applicant's constitutional right to bail. The prosecution failed to demonstrate compelling reasons to deny bail. Accordingly, the application for bail was merited and allowed, subject to conditions.
